A maintenance or warranty bond is the surety's promise to the agency or owner that the contractor or developer will correct defects in materials and workmanship that appear during a set period after the work is accepted. The period starts at acceptance and is set by statute, ordinance or contract: one year under California's Subdivision Map Act security, two years from written acceptance on some Texas city bond forms and the life of any contract guaranty under Arizona's statutory performance bond. It is credit backing the principal's repair obligation, not completed-operations liability insurance, which may respond to third-party injury or damage claims depending on the policy.

## Key Decision Points
- The bond secures a repair promise to the obligee; it does not pay third parties and it is not insurance.
- The clock almost always starts on a written acceptance date, so phased or partial acceptances create several clocks.
- California's Map Act keeps a one-year warranty inside the faithful performance security and lets the agency hold back an amount for it after release.
- Arizona's statutory performance bond already runs through any guaranty the contract requires, so a separate maintenance bond may duplicate it.
- Completed-operations liability coverage and a maintenance bond answer different claims, and most projects need both.

## What a Maintenance or Warranty Bond Guarantees

A maintenance bond, also called a warranty or guarantee bond, picks up where the construction phase ends. The obligee is the agency that accepted the improvements or the owner that accepted the building; the principal is the contractor or developer that built them. The bond condition is that the principal will correct defective work, labor or materials discovered during the stated period and, on many municipal forms, keep the improvements in good repair until the period ends. If the principal does not, the obligee can call on the surety up to the bond amount.

The obligation is narrower than it sounds. A typical form reaches defects resulting from faulty materials or workmanship, not ordinary wear, damage by others or a utility cut made after acceptance by a different contractor. Design responsibility depends on the contract: on design-bid-build public work the agency usually owns the design, while on design-build or developer-designed subdivisions the principal may carry it. The bond incorporates whatever the contract or improvement agreement says.

Because it is surety credit, the principal and its indemnitors repay anything the surety spends correcting work, including engineering and legal costs that many municipal forms list. The bond also stays on the surety's books after the project ends, which matters to contractors watching their aggregate capacity.

The three-party structure behind this bond is explained on the page about [how construction surety bonds work](https://mycontractorsinsurancequote.com/construction-surety-bonds).

## How Long It Runs and When the Clock Starts

The period is set by the law or the document that requires the bond, and the trigger is almost always acceptance, not substantial completion or the contractor's own completion date. That distinction matters on subdivisions, where a city may accept streets and storm drain in one phase and water and sewer in another, each starting its own clock.

California's Subdivision Map Act fixes one year. Government Code §66499.9 limits liability on faithful performance security to items that include the guarantee and warranty of the work for one year following completion and acceptance, against defective work, labor or materials. Section 66499.3(d) lets the legislative body require an amount for that one-year warranty.

Texas cities set their own periods by ordinance and form. The City of New Braunfels maintenance bond form, for example, obligates the principal to correct defects from faulty materials or workmanship and keep the public improvements in good repair for two years from the date the City Engineer accepts them in writing. If a defect is corrected during that period, the form says the city will require a new bond for one full calendar year covering the corrected item, so a repair can extend the obligation beyond the original term.

In Arizona, the statutory performance bond form in A.R.S. §34-222 runs during the original term, any extension and the life of any guaranty required under the contract. The contract's warranty clause therefore sets the length, and the performance bond carries it unless the agency asks for something more.

For developers, the warranty period is the tail end of the improvement security described under [subdivision improvement bonds and security release](https://mycontractorsinsurancequote.com/construction-surety-bonds/subdivision-improvement-bonds).

### Illustrative scenario: A Phased Texas Subdivision with Two Acceptance Dates

Pecan Bend Land Co., a fictional developer, builds a 180-lot subdivision in New Braunfels in two phases. The City Engineer accepts the Phase 1 streets, drainage, water and wastewater in writing in March and Phase 2 in November of the following year, so the city's two-year maintenance bonds expire 20 months apart. In the 19th month of Phase 1, a 60-foot section of pavement over a sanitary sewer trench settles. The city sends written notice of the defect to Pecan Bend, which forwards it to its site contractor, Guadalupe Underground. Guadalupe's subcontract warranty ran one year from its own completion and has already expired, so Pecan Bend pays to have the trench re-compacted and repaved within the time the city allowed. Under the bond form, the city then requires a new one-year maintenance bond for the repaired section, extending Pecan Bend's surety obligation on that block past the original Phase 1 end date. On its next subdivision, Pecan Bend changes its subcontract so the site contractor's warranty and maintenance bond run two years from the city's written acceptance.

## A Separate Bond, or the Performance Bond Carried Forward

Whether a project needs a stand-alone maintenance bond depends on how the performance security is written and released. In California, Government Code §66499.7 has the agency release faithful performance security on final completion and acceptance, but subsection (i) says the release does not apply to the warranty period under §66499.9 or to the amount the agency deems necessary to secure it. In practice, many California agencies either keep part of the performance bond open for a year or exchange it for a smaller warranty bond.

Texas public work follows a different logic. Under Government Code §2253.078, a suit on a public work performance bond may not be brought after the first anniversary of final completion, abandonment or termination of the contract. A Texas agency that wants a two-year warranty secured beyond that window usually asks for a separate maintenance bond, as New Braunfels does with its own two-year form.

In Arizona, because the statutory performance bond already reaches the life of any guaranty, a separate maintenance bond on public work may duplicate it. Contractors should ask the agency before buying both, and should confirm whether the contract warranty starts at final acceptance or at each partial acceptance.

## How It Differs from Completed-Operations Liability Coverage

Buyers sometimes assume their completed-operations coverage makes a maintenance bond unnecessary, or the reverse. The two answer different claims. A maintenance bond backs the principal's promise to the obligee to repair its own defective work. Completed-operations coverage in a commercial general liability policy may respond to claims by third parties for bodily injury or property damage arising from finished work, depending on the form, the endorsements and the facts.

The gap shows up in a cracked curb or a settled trench. Repairing the contractor's own defective work is a contract obligation, and standard liability forms commonly exclude damage to the insured's own work, subject to exceptions such as work performed by subcontractors. If a pedestrian trips on that curb or a settled trench damages a resident's driveway, the third-party claim is the kind completed-operations coverage was built for, and the city's repair demand under the bond is not.

There is also a timing difference. The bond period is measured in months or a few years after acceptance. Construction defect exposure under the statutes of repose in California, Texas, Arizona and Nevada can run far longer, which is why project policies often carry extended completed-operations terms.

## Who Carries the Bond: Developer, General Contractor or Subcontractor

On a subdivision, the developer is the principal on the city's warranty security even when a general contractor and civil subcontractors built the improvements. The city looks to the developer and its surety; the developer has to look down the chain. Developers manage that by requiring their GC and site subcontractors to furnish maintenance bonds to the developer, with the same period, the same acceptance trigger and the same defect language as the city's form.

On public work, the prime contractor is the principal, and the same logic applies one tier down. A paving or utility subcontractor whose work fails in the warranty period has created a claim against the prime's bond. Subcontract warranty clauses that match the prime contract, backed by subcontractor bonds where the scope is large, keep the obligation with the party that did the work.

Mismatches are common. A subcontract warranty that runs one year from the sub's completion will expire well before a two-year city warranty that starts at the city's final acceptance of the whole subdivision.

## Closing Out the Obligation and Freeing Capacity

An open maintenance bond counts against the principal's surety program until the obligee releases it, and sureties look for evidence that the period has ended. Calendar the end date from the written acceptance letter, schedule a walk with the agency inspector before it arrives and request a written release. The New Braunfels form, for instance, gives the surety 45 days after written notice of default to correct the defect, so a principal that responds to the city's first notice quickly keeps the claim off the surety's desk.

Keep records that prove the condition of the work at acceptance: as-built drawings, compaction and density test results, CCTV inspection of sewer and storm lines and photographs. When a defect claim arrives, that file often decides whether it is a construction defect, damage by another party or normal maintenance.

## Before You Ask for a Quote

### What to Gather
- The improvement agreement, contract warranty clause and any agency maintenance bond form
- The written acceptance letter or resolution for each phase, with dates
- The engineer's estimate or contract value the bond amount will be based on
- Subcontract warranty clauses and any subcontractor maintenance bonds
- As-built drawings, compaction and test reports and sewer and storm CCTV records
- The current list of open performance and maintenance bonds with expected release dates

### What to Ask the Insurer or Surety
- Does the performance bond already carry the warranty period, or does the agency need a separate bond?
- When exactly does the period start: substantial completion, each partial acceptance or final acceptance?
- Does the form require maintenance as well as defect correction, and does it reach design?
- What notice and cure period does the form give before the agency can call the surety?
- Does a repair during the period trigger a new or extended bond?
- What documents will the agency and surety need to release the bond at the end of the term?

## Broker Notes

**Quick Answer:** A maintenance or warranty bond secures the principal's promise to correct defective work for a set period after acceptance, commonly one year under California's Map Act security and two years on many Texas city forms. It is surety credit owed back by the principal, not liability insurance.

**Common Mistake:** Letting subcontract warranties run from the subcontractor's own completion date while the city's warranty runs from final acceptance of the whole project, leaving the developer or prime contractor to pay for late defects with no one to pass them to.

**Broker Perspective:** A broker matches the warranty trigger, length and defect language across the agency form, the prime contract and every subcontract, and tracks release dates so open maintenance bonds do not quietly consume the principal's aggregate surety capacity.

**Coverage Impact:** Repairing the contractor's own defective work is a bond and contract obligation that liability policies commonly exclude, while third-party injury or property damage from completed work may fall under completed-operations coverage depending on the form and endorsements.

## Questions Buyers Ask

### Our California city released the performance bond but kept part of it. Why?

Government Code §66499.7(i) says the release of faithful performance security does not apply to the one-year guarantee and warranty period under §66499.9 or to the amount the agency deems necessary to secure it. Many agencies hold a portion of the bond, or ask for a smaller warranty bond in exchange, until the year after acceptance ends.

### Can a repair during the warranty period extend our maintenance bond?

It can, if the form says so. Some Texas city forms require a new bond for one full calendar year on any defect corrected during the original period, which extends the obligation on that item. Read the agency form before bidding or platting, because the extension can reach past the date you planned to close out the surety obligation.

### Does an Arizona public works contract need a separate maintenance bond?

Often it does not. Arizona's statutory performance bond form in A.R.S. §34-222 runs through the life of any guaranty the contract requires. An agency may still specify a separate warranty bond in its documents, so check the bid package and ask whether the performance bond can carry the warranty instead of buying both.

### If our liability policy has completed operations, why does the city still want a maintenance bond?

They secure different promises. The bond guarantees the city that you will fix your own defective work, an obligation most liability forms exclude as damage to your work. Completed-operations coverage may respond when finished work injures someone or damages someone else's property, depending on the policy. Cities want the repair guaranteed regardless of fault or insurance.

### Who should be the principal on a subdivision warranty bond when our GC built the streets?

The city usually requires the developer that signed the improvement agreement to be principal, because the agreement is the developer's obligation. The developer can protect itself by requiring the GC and site subcontractors to furnish matching maintenance bonds to the developer, running from the same acceptance date and for the same term as the city's.
