Legal
Terms of Use
These Terms of Use govern access to and use of mycontractorsinsurancequote.com and any related website operated by Gleason Insurance Brokers, LLC ("Gleason Insurance Brokers," "GIB," "we," "us," or "our").
By accessing or using this website, you agree to these Terms. If you do not agree, do not use the website.
1. General Information Only
Website content is provided for general informational and marketing purposes. It does not constitute:
- An insurance policy;
- An insurance binder;
- A quote or guarantee of pricing;
- Confirmation of coverage;
- Legal, tax, accounting, engineering, safety, or risk-management advice;
- A representation that any insurer will accept a risk;
- A promise that any particular coverage, limit, endorsement, classification, or program is available; or
- A recommendation that any particular insurance product is appropriate for every business.
Insurance terminology is summarized for convenience. Actual coverage is governed exclusively by the issued policy, declarations, forms, endorsements, exclusions, conditions, and applicable law.
2. No Guarantee of Quotation or Coverage
Submitting a website form, application, document, payment information, certificate request, or other communication does not:
- Create an insurance contract;
- Bind, renew, extend, amend, reinstate, or cancel coverage;
- Guarantee that a quote will be obtained;
- Guarantee carrier approval;
- Guarantee any price, premium, classification, limit, deductible, endorsement, or effective date; or
- Require us or any insurer to accept or place the risk.
All insurance is subject to carrier availability, underwriting review, complete and accurate information, acceptable inspections and reports, payment requirements, eligibility criteria, applicable laws, and final written approval.
Quotes and indications may be withdrawn or revised. Premiums, fees, taxes, assessments, finance charges, deductibles, terms, conditions, classifications, exclusions, and required documentation may change before binding.
3. Coverage Is Not Bound Through the Website
Coverage cannot be bound, modified, renewed, reinstated, or cancelled through the website, voicemail, text message, or ordinary email unless you receive express written confirmation from an authorized representative with authority to confirm the transaction.
Do not assume coverage is in effect merely because you:
- Submitted an application;
- Requested a quote;
- Sent documents;
- Made or attempted a payment;
- Received an automated confirmation;
- Requested an endorsement or certificate;
- Left a voicemail;
- Sent an email or text message; or
- Previously discussed the transaction with us.
You must receive written confirmation that the carrier or properly authorized representative has approved and completed the requested action. Effective dates cannot be backdated unless expressly approved in writing by the carrier and legally permitted.
4. Accuracy and Completeness of Information
You are responsible for providing complete, current, and accurate information. Insurance carriers rely on information provided in applications, supplemental forms, schedules, audits, inspections, statements, and communications.
Material omissions, inaccuracies, misrepresentations, or changes in operations may result in revised pricing, coverage restrictions, cancellation, nonrenewal, rescission, denial of a claim, or other consequences permitted by the policy or law.
You must promptly disclose material changes, including changes involving:
- Business operations or classifications;
- Ownership or entity structure;
- Payroll, sales, subcontractor costs, or revenue;
- Employees, drivers, vehicles, trailers, or equipment;
- Geographic areas or operating radius;
- New projects or contractual obligations;
- Claims, losses, incidents, violations, citations, or license status;
- Property values, locations, occupancy, construction, or protection;
- Prior insurance, cancellations, nonrenewals, or lapses; and
- Any other information relevant to underwriting.
5. Quotes, Indications, and Proposals
A quote, indication, estimate, comparison, or proposal is not a policy and may not reflect every policy provision.
Quotes are based on information available at the time and may be subject to:
- Completed and signed applications;
- Supplemental applications;
- Carrier underwriting approval;
- Loss runs and claims information;
- Motor vehicle records;
- Inspections;
- Financial information;
- Contracts and certificates;
- Driver, vehicle, equipment, or property schedules;
- Minimum premiums;
- Premium audits;
- Taxes, assessments, and policy fees;
- Broker fees documented separately where permitted;
- Premium financing approval;
- Down payment and cleared funds;
- Signed disclosures and forms; and
- Other carrier requirements or subjectivities.
You are responsible for reviewing every quote and policy carefully, including named insureds, operations, classifications, limits, deductibles, exclusions, endorsements, locations, vehicles, drivers, equipment, and effective dates.
6. Policy Documents Control
If any website statement, email, certificate, proposal, summary, advertisement, or oral discussion conflicts with an issued policy, the policy and its endorsements control.
Coverage summaries cannot describe every term, condition, limitation, exclusion, or endorsement. Only the insurer may determine whether a particular claim is covered, subject to the policy and applicable law.
7. Certificates of Insurance
A certificate of insurance is evidence of information shown on the policy as of the certificate date. Unless the policy is properly endorsed, a certificate does not:
- Create coverage;
- Amend, extend, or alter coverage;
- Add an additional insured;
- Grant a waiver of subrogation;
- Establish primary and noncontributory status;
- Change cancellation notice;
- Satisfy every contractual insurance requirement; or
- Confer rights beyond those provided by the policy.
Contract requirements should be provided before coverage is purchased or a project begins. The availability of requested endorsements is subject to carrier approval, policy terms, eligibility, and additional premium.
8. Contract Review
We may review insurance requirements to assist with identifying requested coverages, limits, or endorsements. Any such review is limited to insurance considerations and is not legal advice or a legal opinion concerning the contract.
Contract and insurance reviews are a courtesy service that may be available at times, depending on our workload and on the size, timing and complexity of the project. A review is not guaranteed and is limited to insurance considerations. It is not legal advice and is not a substitute for advice from your own legal counsel, which you may need before signing a contract or obtaining coverage.
We do not guarantee that a policy satisfies every contract, lender, governmental, licensing, project, or certificate requirement. You should have contracts reviewed by qualified legal counsel.
9. Premiums, Fees, Financing, and Audits
Premiums may be subject to deposit requirements, minimum earned premium, fully earned premium, short-rate cancellation, installment fees, taxes, assessments, premium audits, or other policy provisions.
Broker fees, when applicable, will be disclosed in a separate written agreement as required by law. The amount and availability of a broker fee may depend on the transaction, carrier, market, and method of placement.
Premium financing is subject to separate approval and agreements with the finance company. Failure to make required payments may result in cancellation proceedings.
Estimated premiums based on payroll, sales, subcontractor costs, receipts, units, or other exposures may be audited. Final audited premium may be higher or lower than the original estimate.
10. Admitted and Nonadmitted Insurance
Insurance may be placed with an admitted insurer or, when appropriate and legally permitted, through the surplus lines market with a nonadmitted insurer.
A nonadmitted insurer is not licensed by the California Department of Insurance in the same manner as an admitted insurer, and its policies may not be protected by the California Insurance Guarantee Association. Any required surplus lines disclosures will be provided as part of the insurance transaction.
Nothing on this website guarantees that an admitted or nonadmitted market will be available for a particular risk.
11. No Duty to Monitor
Unless specifically agreed in writing, we do not undertake a continuing duty to monitor your business, contracts, licenses, operations, payroll, vehicles, drivers, property values, legal obligations, or changing insurance needs.
You are responsible for notifying us of changes and requesting coverage reviews. We recommend reviewing insurance at least annually and whenever operations, ownership, contracts, property, vehicles, staffing, or exposures materially change.
12. Claims and Potential Claims
Promptly report any claim, accident, incident, circumstance, demand, lawsuit, or potential loss in accordance with the policy's notice requirements.
Sending claim information to us does not guarantee that notice has been accepted by the insurer or that the claim is covered. If a deadline is approaching, contact the insurer directly using the reporting information contained in the policy and retain confirmation.
We do not make claim-coverage decisions and cannot guarantee claim payment or outcome.
13. Third-Party Information and Links
The website may contain information supplied by insurers or other third parties and may link to third-party websites. We do not control and do not guarantee third-party content, products, services, security, availability, or privacy practices.
Carrier names, trademarks, program descriptions, and coverage references belong to their respective owners. References to a carrier or program do not guarantee appointment, market access, availability, eligibility, or acceptance.
14. Website Availability and Accuracy
We attempt to maintain useful and accurate information, but website content may contain errors, omissions, or outdated information. Insurance laws, carrier appetites, underwriting rules, pricing, forms, and market availability change frequently.
We do not warrant that the website will be uninterrupted, secure, current, complete, or error-free. We may modify, suspend, restrict, or discontinue any part of the website without notice.
15. Acceptable Use
You may not:
- Use the website unlawfully or fraudulently;
- Submit false, misleading, incomplete, or unauthorized information;
- Attempt to access systems or information without authorization;
- Introduce malware or harmful code;
- Interfere with website security or operation;
- Scrape, copy, or harvest information using automated means without permission;
- Impersonate another person or business;
- Violate intellectual-property, privacy, or contractual rights; or
- Use website content to create misleading insurance advertising.
This does not restrict search engines, AI crawlers or AI assistants from reading, indexing, citing or learning from the public pages of this site, as our robots.txt allows.
16. Intellectual Property
Unless otherwise stated, website text, graphics, branding, design, organization, and original content are owned by or licensed to Gleason Insurance Brokers, LLC and are protected by applicable intellectual-property laws.
You may view and print reasonable portions for your own legitimate business use. You may not reproduce, republish, sell, modify, distribute, or commercially exploit website content without prior written permission.
17. Disclaimer of Warranties
To the fullest extent permitted by law, the website and its content are provided "as is" and "as available," without express or implied warranties, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, non-infringement, availability, or security.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
18. Limitation of Liability
To the fullest extent permitted by law, Gleason Insurance Brokers, LLC and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from website use, website unavailability, reliance on general website information, third-party services, or electronic transmission failures.
Nothing in these Terms limits liability that cannot legally be limited or modifies duties imposed by applicable insurance law.
19. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Gleason Insurance Brokers, LLC and its owners, officers, employees, contractors, and representatives from third-party claims arising from your unlawful use of the website, violation of these Terms, infringement of another person's rights, or submission of information you were not authorized to provide.
20. Electronic Communications
By communicating electronically, you consent to receive electronic responses and records where legally permitted. Electronic communications may be delayed, intercepted, misdirected, corrupted, or unsuccessful.
An automated email or website confirmation only confirms receipt of a transmission. It does not confirm that the submission was reviewed, accepted, or acted upon and does not bind insurance.
21. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, disputes concerning website use shall be brought in a court of competent jurisdiction located in Sacramento County, California.
22. Severability
If any provision is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
23. Changes to These Terms
We may revise these Terms periodically. Changes become effective when posted unless otherwise stated. Continued use of the website after the effective date constitutes acceptance of the revised Terms.
